1. Agreement to Terms

By booking a tour, expedition, or service with Explorail Travel Company ("Explorail", "we", "our", or "us"), you agree to be bound by these Terms and Conditions. Please read them thoroughly before confirming your booking.

2. Booking & Payment Policy

• Slot Confirmation: A trip slot is confirmed only upon receipt of the designated advance booking amount.
• Non-Refundable Advance: The advance booking amount paid to secure your slot is strictly non-refundable under all circumstances, as it is immediately utilized for securing train reservations and accommodation blockings.
• Final Payment: The remaining trip balance must be cleared at least 7 days prior to the departure date, unless explicitly agreed otherwise in writing.
• Pricing: All package rates are subject to availability and inclusion details outlined in your personalized itinerary document.

3. Rail Expeditions & Transport

• Explorail facilitates rail reservations in coordination with Indian Railways. Train schedules, platform assignments, and operational delays are subject to railway administration.
• In the event of train delays, cancellations, or rescheduling by Indian Railways, our team will make reasonable efforts to adjust connecting logistics, though Explorail cannot be held liable for third-party transport disruptions.

4. Health, Fitness & Trekking Liability Waiver

• Assumption of Risk: Outdoor adventure travel, rail journeys, high-altitude trekking, forest trails, and remote expeditions involve inherent risks. By participating, you voluntarily assume all associated risks and dangers.
• Limitation of Liability: Explorail Travel Company, its organizers, coordinators, trek leaders, and partners shall not be held liable or legally responsible for any unforeseen circumstances, including but not limited to accidents, personal injury, medical emergencies, illness, permanent disability, loss or damage of personal property, or death occurring during any part of the trip or trek.
• Medical Fitness: Participants must ensure they possess the necessary health and stamina for the trip. Travelers must disclose any pre-existing medical conditions (e.g., cardiac issues, asthma, allergies, vertigo) prior to booking.
• Guide Authority: Safety instructions, pace guidelines, and emergency directives given by our certified trek leaders must be strictly obeyed at all times.
• Insurance: We strongly advise all participants to obtain comprehensive personal travel, medical, and accidental insurance prior to joining any expedition.

5. Cancellation Policy

All advance booking amounts and payments made to reserve an expedition slot are strictly non-refundable under any circumstances. Once confirmed, booking funds are immediately utilized for securing non-refundable train tickets, vehicle charters, homestay holds, and forest/trek permits.

• In the event of cancellation by the traveler for any reason, no refund or advance adjustment will be provided.
• Slot transfers to another person may be evaluated on a case-by-case basis prior to ticket issuance, subject to permit availability and administrative approval.

6. Group Code of Conduct

Explorail promotes community harmony and responsible ecotourism. Any behavior that causes disturbance, harassment, disrespects local communities, or endangers fellow travelers may result in immediate dismissal from the tour without refund.

7. Force Majeure

Explorail shall not be held responsible for cancellations, delays, or itinerary modifications caused by events beyond reasonable control, including natural calamities, extreme weather, landslides, roadblocks, strikes, or governmental travel restrictions.

8. Governing Law & Jurisdiction

These terms and conditions are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with our services shall be subject to the exclusive jurisdiction of the courts in Kottarakkara / Kollam, Kerala.
